Terms of Service
Effective: October 3, 2026. These Terms govern access to and use of the Weather Trading Intelligence API, dataset downloads, and website (the "Service"), operated by Atmos Data Labs ("Atmos Data Labs", "we", "us"). By creating an account, accessing the API, or downloading any part of the dataset, you ("Customer", "you") agree to these Terms. If you do not agree, do not use the Service.
1. The dataset license is separate
These Terms govern your account and your relationship with us as a service provider. Your rights to actually use the weather dataset itself — what you may and may not do with the data you download or retrieve via the API — are governed by the Atmos Weather Dataset License, which is incorporated into these Terms by reference. If the two documents conflict on a data-usage question, the Data License controls.
2. Accounts and API keys
- You must provide an accurate email address and are responsible for keeping your password and API key(s) confidential.
- API keys are issued per account and are not to be shared, sold, or sublicensed — usage under your key is treated as usage by you, including for quota and billing purposes.
- You're responsible for all activity under your account. Tell us at contact@atmosdatalabs.com right away if you suspect a key has been compromised, and revoke it from your account page.
- We may suspend or revoke API keys we reasonably believe are being used to abuse, overload, or circumvent the rate limits of the Service.
3. Plans, billing, and cancellation
- Current plans and pricing are published at /pricing. We may change prices or quotas for future billing periods with reasonable notice; changes do not apply retroactively to a period you've already paid for.
- Paid plans are billed in advance on a recurring monthly subscription and processed by Stripe, our third-party payment processor. We do not receive or store your full card number.
- You can cancel a paid subscription at any time from your account page or the Stripe billing portal; cancellation takes effect at the end of the current billing period, and you keep paid-tier access until then. We do not currently offer partial-period refunds, except where required by applicable law.
- If a payment fails and isn't resolved, we may downgrade your account to the Free plan and/or suspend API access until payment succeeds or you cancel.
- Enterprise plans are billed by invoice under custom terms agreed in writing (including these Terms and the Data License); where a signed enterprise order conflicts with these Terms, the signed order controls for that customer.
4. Acceptable use of the Service
In addition to the dataset-specific restrictions in the Data License, you agree not to:
- Attempt to circumvent rate limits, quotas, or authentication;
- Probe, scan, or test the vulnerability of the Service, or interfere with its normal operation;
- Use the Service for any unlawful purpose, or in a way that infringes a third party's rights;
- Misrepresent your identity or affiliation when creating an account or contacting us.
5. Availability
We aim to keep the API and dataset downloads available, but the Service is provided without any guarantee of uninterrupted or error-free operation. We may perform maintenance, change endpoints with reasonable notice, or experience outages outside our control. The Service is an actively developed research/data product, not a mission-critical utility — do not build systems that assume zero downtime.
6. Accuracy disclaimer
Weather observations and forecasts are inherently uncertain and subject to revision, measurement error, and gaps in upstream source data. We do not warrant that any observation, forecast, error metric, or probability curve in the dataset is accurate, complete, or free of errors. You are solely responsible for independently validating the data before relying on it for any purpose.
7. Not investment advice
The Service is a research and data-infrastructure product. Nothing in the dataset, documentation, website, or any communication from us constitutes investment, trading, or financial advice, or a recommendation to buy, sell, or hold any security, contract, or position. Any trading or investment decisions you make using the data are made entirely at your own risk.
8. Intellectual property
We own the Service's software, website, documentation, branding, and our own derived analytics (point-in-time alignment, forecast-error calculations, revisions, and probability curves), except for upstream source data owned by its original providers (see the Data License's provenance table). Nothing in these Terms transfers ownership of the Service to you; you receive only the limited rights described here and in the Data License.
9. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms or the Data License, including non-payment, API abuse, or prohibited redistribution of the dataset. On termination, your right to access the Service ends immediately; any copies of the dataset you already downloaded remain subject to the Data License's restrictions, which survive termination.
10. Limitation of liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. Atmos Data Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or trading losses, arising from your use of or inability to use the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the 3 months immediately preceding the event giving rise to the claim.
11. Governing law
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You and we both submit to the exclusive jurisdiction of the courts located in British Columbia for any dispute not otherwise resolved.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll update the effective date above and, where practicable, notify active paid subscribers by email before the change takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
